Agile Equipment Returns and Refunds Policy

At Agile Equipment, we strive to provide our customers with high-quality equipment and exceptional service. We understand that there may be instances where you need to return or seek a refund for the equipment or products you have hired or purchased from us. This Returns and Refunds Policy outlines the guidelines and procedures for returns and refunds. Please read this policy carefully before making a purchase or hiring from us.

1. Returns and Refunds Eligibility

1.1 EQUIPMENT PURCHASE RETURNS AND REFUNDS:

a) Purchase: As a part of our change-of-mind policy, new equipment and products may be eligible for return or refund within 7 days from the date of delivery, provided it is in its original condition and packaging. A proof of purchase must be provided. We cannot accept refunds where the client has tampered with, damaged, self-repaired, broken the seal, or lost any item part of the equipment. This does not affect a customer’s rights under Australian Consumer Law regarding faulty or misrepresented products.

b) Used Equipment: Used equipment is sold with all known faults disclosed at the time of purchase. However, used equipment is still covered under Australian Consumer Law. If a used product has a major defect not disclosed at the time of purchase, it may be eligible for repair, replacement, or refund in accordance with ACL.

c) Products purchased from Agile Equipment can be returned within 7 days of delivery, provided that the product description does not specify any other conditions. The acceptable reasons for return include physical damage to the product (not caused in a situation where the client is responsible), a defective product (in cases where the original manufacturer does not offer a warranty), and if the product significantly deviates from the description, such as incorrect size, colour, quality, or material-related issues.

d) Restocking Fee: We reserve the right to impose a restocking charge equal to 20% of the invoice price for goods shipped to you and returned to us for any reason other than as provided in Paragraph 1.1(a). This fee does not apply if the product is faulty or does not match its description.

1.2 EQUIPMENT HIRE RETURNS AND REFUNDS:

a) Short-Term Hire: We charge a minimum of 2 days’ hire for any equipment. If the client changes their mind within 24 hours, they will still be charged the 2-day hiring fee and delivery/pickup fee if applicable. If delivery & pickup costs apply, it cannot be discounted unless the client delivers the product back to the Agile warehouse; in this case, the delivery charge can be discounted to half.

b) If the hire service was misrepresented, faulty, or not provided as agreed, the customer is entitled to a refund or service correction as per Australian Consumer Law.

1.3 WARRANTIES:

a) Where the Australian Consumer Law applies, the Customer has the benefit of guarantees in relation to the hire of the Equipment which cannot be excluded.

b) Where the Australian Consumer Law applies and the goods are not of a kind ordinarily acquired for personal, domestic, or household use or consumption, Agile Equipment’s liability in respect of any guarantee is limited to the replacement or repair of the goods, or the cost of having the goods repaired or replaced.

c) To the extent that the Australian Consumer Law (or any other law which cannot be excluded) does not apply, Agile Equipment makes no representations and gives no warranties other than those set out in these Hire Contract Conditions and will not be liable to the Customer for any damages, costs, or other liabilities whatsoever (including for consequential loss) in relation to the hiring of the Equipment by the Customer.

1.4 BY-ORDER ITEMS

a) Payment Requirement: All by-order items require full payment before an order can be processed and placed with our suppliers.

b) Return Policy: By-order items are not eligible for change-of-mind returns. However, they are covered under Australian Consumer Law. If a by-order item is defective, not as described, or damaged upon arrival, it may be eligible for a refund or replacement in accordance with ACL.


2. Return Process

2.1 EQUIPMENT PURCHASE RETURNS:

a) Contact our customer service team within the eligible return period to initiate the return process. Provide your order details, proof of purchase, and reason for the return.

b) If the return is approved, you will receive instructions on how to return the equipment.

c) Return the equipment in its original condition and packaging, including all accessories and manuals, to the designated return address. We accept personal deliveries at our office as well.

d) Once we receive the returned equipment and verify its condition, we will process the refund in accordance with the original payment method, excluding any applicable shipping or handling charges.

2.2 EQUIPMENT HIRE RETURNS:

a) Prior to the agreed hire period, contact our customer service team to arrange the return of the equipment. If delivery & pickup costs apply, it cannot be discounted unless the client delivers the product back to the Agile warehouse; in this case, the delivery charge can be discounted to half.

b) Return the equipment on the specified date and time to the designated drop-off location.

c) Our team will inspect the equipment to ensure it is in the same condition as when it was hired.

d) If the equipment is returned in satisfactory condition, your hire agreement will be closed, and any applicable security deposit will be refunded as per the terms of the agreement.


3. Refunds

3.1 EQUIPMENT PURCHASE REFUNDS:

a) Refunds for eligible returns will be processed within 1-3 business days after we receive the returned equipment and verify its condition.

b) The refund will be issued using the original payment method unless otherwise agreed upon by both parties.

3.2 EQUIPMENT HIRE REFUNDS:

a) Refunds for unused hire periods, cancellations, or other eligible cases will be processed as per the terms and conditions outlined in the hire agreement.

b) Any applicable refund will be issued within 1-3 business days using the original payment method or an agreed alternative.

Agile Equipment reserves the right to make the final decision regarding returns and refunds and to exercise discretion in exceptional cases not explicitly covered by this policy.
